SaaS Terms & Conditions

1. Introduction Welcome to Jotfirst Data Solutions (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Agreement”) govern your use of our IoT Monitoring Software-as-a-Service (SaaS) platform, which provides real-time monitoring, live dashboards, push notifications, and report generation for industries including but not limited to Food & Beverage, Pharmaceutical & Healthcare, Agriculture & Poultry, Warehouse & Manufacturing. By accessing and using our services, you agree to these terms.

2. Subscription & Payment 2.1 Our service operates on a subscription basis with flexible payment options, including full payment, advance payment, or monthly installments, subject to promotional campaigns and specific agreements. 2.2 A subscription is deemed active once the customer agrees to the implementation plan. No refunds or cancellations will be entertained after the implementation has commenced. 2.3 Implementation fees may apply depending on the complexity of the use case scenario.

3. Service Access & Usage 3.1 Our service is web-based and accessible through an internet connection. 3.2 Each account is limited to five (5) users. Any changes or variations are subject to our specific offers and agreements. 3.3 Users are responsible for maintaining the confidentiality of their account credentials and ensuring that only authorized personnel access the system.

4. Data Collection & Privacy 4.1 We collect and store sensor data, sensor reports, user email addresses, phone numbers (for email and WhatsApp alerts), and web session information. 4.2 We comply with the Malaysia Data Protection Act and ensure that all collected data is securely stored on the cloud. 4.3 We do not share customer data with third parties. Users retain ownership of their data and may request backups as needed.

5. Service Level Agreement (SLA) & Support 5.1 We adhere to a standard SLA for service availability, maintenance, and support response times. 5.2 In case of scheduled maintenance, users will be notified in advance. 5.3 We provide customer support through designated channels as outlined in our support policy.

6. Termination & Suspension 6.1 We reserve the right to suspend or terminate accounts due to violation of these terms or unauthorized system use. 6.2 No refunds will be issued upon termination of service.

7. Intellectual Property Rights 7.1 We retain full ownership of the SaaS platform, including software, features, and proprietary content. 7.2 Customers own their data and may request a backup upon request. 7.3 Users are not permitted to modify, customize, or alter the software in any way.

8. Liability & Disclaimers 8.1 We strive to maintain high service availability but do not guarantee uninterrupted or error-free service. 8.2 We are not liable for any indirect, incidental, or consequential damages arising from service usage, including data loss. 8.3 Users acknowledge that environmental factors and third-party devices may impact sensor readings, and we are not responsible for any discrepancies beyond our control.

9. Governing Law & Dispute Resolution 9.1 This Agreement shall be governed by and construed in accordance with the laws of Malaysia. 9.2 Any disputes arising out of or in connection with these terms shall be resolved through negotiation, and if necessary, escalated to mediation or arbitration in Malaysia.

10. Amendments & Updates 10.1 We reserve the right to update or modify these Terms & Conditions at any time. Continued use of the service after changes are published constitutes acceptance of the updated terms.
